Terms & Conditions

  1. APPLICABILITY OF TERMS AND CONDITIONS

These terms and conditions shall be incorporated into the contract and shall apply in place of and prevail over any terms and conditions contained or referred to in any communication from the participant or implied by custom or practice. Other terms and conditions are expressly rejected by Vision of Adventure.

  1. BOOKING CONDITIONS
  • The contract shall be formed when Vision of Adventure acknowledges acceptance of the participant’s booking form and required payment.
  • The contract is subject to availability of a course place/date and the acceptance by the participant of these terms and conditions.
  • Neither Vision of Adventure website, nor literature constitutes an offer and Vision of Adventure may correct any errors or omissions to its published prices at any time prior to the confirmation of the contract in accordance with this condition.
  • All information is produced in good faith that it is accurate at the time of publishing.
  • Any current price list replaces all previous price lists.
  1. PAYMENTS

We will accept payment by credit/debit card, bank transfer and by cheque. (Payments by bank transfer or cheque are preferred to avoid Vision of Adventure incurring processing costs).

  • Payments made by credit/debit card are done on-line through the Paypal payment processing system. (You do not have to have a Paypal account to use this system).
  • Bank Transfer details are/will be included in your invoice. Please include your name as a reference. An email saying you have paid will also assist us!
  • Cheques should be made payable to Vision of Adventure and sent to: 5 Highgrove, Bankfield, Kendal, LA9 5DR. In the event of any cheque from the participant being dishonoured a charge of £25, will be made to cover bank and administrative costs.

Payments can made in full (our preference) at time of booking or by Initial Deposit and Final Balance. Balance payments must be received 6 weeks prior to commencement of the course. No reminders will be sent. Failure to pay your balance on time will be treated as a cancellation by you.

  1. CANCELLATION – BY VISION OF ADVENTURE
  • Vision of Adventure reserves the right to cancel any course which does not have sufficient people taking part to make it financially viable or if insufficient sighted guides are available. Vision of Adventure will endeavour to ensure that a course runs if at all possible. If your booking is likely to be cancelled under such circumstances, Vision of Adventure undertakes to inform you as soon as possible; this will not occur less than 6 weeks before the course start date.
  • Anyone booked onto a course which is cancelled by Vision of Adventure will be entitled to a full refund of monies paid or entitled to transfer to another course and no transfer fee will be payable. Should you transfer to another course any difference in price will be invoiced or credited accordingly.
  1. CANCELLATION – BY THE PARTICIPANT
  • Deposits are non-refundable. You are advised to take out your own travel insurance when you book. This may allow you to recover prior payments (usually less an excess) if you have to cancel and the circumstances of your cancellation are covered by the insurance contract.
  • All cancellations must be in writing and sent by email to office@viREMOVEsionofadventure.org. Vision of Adventure will acknowledge a cancellation within 5 days of receiving it. Until the participant has received confirmation the original booking remains valid.
  • To cover Vision of Adventure expenses, the following cancellation policy applies:
    • If you cancel your booking more than 6 weeks before the first day of your course, you will receive a refund of monies paid, minus your non-refundable deposit.
    • If you cancel your course less than 6 weeks before the first day of your course you will receive no refund on monies paid.
    • In the event that a deposit is paid but the full amount is not paid within 6 weeks of an activity, this will be taken as a cancellation by you and no refund will be made.
    • In the event of a no-show or not arriving on time for an activity no refund will be made.
    • If possible, Vision of Adventure will endeavour to resell your place and refund all or part of your payment if you are unable to attend but this is entirely at our discretion. Please arrange your own cancellation insurance because, as a small charity, we may not be able to refund your course fees whatever the reason for cancellation.

Similar cancellation terms are adopted throughout the travel industry and cover the costs of advance payments made by Vision of Adventure, and the effect of your booking having prevented others from taking your place. Cancellation charges may be covered, in part, by your travel insurance provided the reason for cancellation falls within the terms of the policy.

  1. HEALTH
  • Participants in courses/activities must expect to be involved in adventurous and sometimes strenuous activities. Although prior experience and/or training is not necessary on all the courses/activities participants are expected to be of good general health. The personal information form must be completed as part of the booking process. All prior injuries and/or serious illnesses must be declared. Any injury or illness occurring between the time of the declaration and the commencement of the course must be reported. The participant must satisfy him/herself that taking part in the course is within his/her own capabilities. Vision of Adventure reserves the right to refuse a course participation on medical grounds if it is considered to be detrimental to the safety and smooth running of the course.
  • Sighted guides will assist with normal day to day guiding both during the activities and at other times on the course. They are not carers, participants must be able to manage their personal requirements independently.
  • Participants must be willing and able to follow safety instructions and not act in ways detrimental to the rest of the group.
  1. COURSE SIZES
  • Course sizes described in promotional literature or on the website are target sizes and may be increased or decreased at the discretion of Vision of Adventure. Vision of Adventure gives no undertaking as to the minimum or maximum size of a course but does undertake to ensure that Leaders, Instructors and support staff are supplied in appropriate numbers to ensure the principle objectives of the course can be achieved. Similarly, Leaders, Instructors and support staff named in course descriptions, anywhere in the literature or on the website, may be changed at any time.
  1. DIETARY REQUIREMENTS
  • Any special dietary requirements must be requested at the time of booking. Vision of Adventure cannot accept responsibility for not being able to deliver special dietary needs at short notice.
  1. GUIDE DOGS
  • In order to accommodate guide dogs and provide dog sitting cover participants must specify at time of booking whether they intend to bring their guide dog along.
  1. SAFETY
  • Outdoor adventurous activities take place in varied natural environments where there are natural hazards and risks to manage. Every effort will be made by the Vision of Adventure staff to provide realistic training in a safe manner. All staff employed by Vision of Adventure are trained and appropriately qualified / experienced to run activity sessions and will at all times proceed in a manner to limit the risk of injury. However, participants need to accept that accidents and injuries can happen.
  • Participants on courses and activities are expected to comply with all safety guidance and instructions given by Vision of Adventure and its staff.
  • Instructors reserve the right not to complete an activity with clients who may be deemed to unable or unwilling to follow our instructors’ advice.
  • The participant is responsible for the safekeeping of all equipment issued for use during the activity/course. With the exception of fair wear and tear Vision of Adventure reserves the right to charge for equipment that has been lost or misused.
  • It is a condition of booking that you read and acknowledge the participation statement for your chosen activity.
  1. UNRULY BEHAVIOUR
  • Behaviour that disrupts the smooth running of an event may result in the disruptive participant(s) being excluded.  Any damage caused to property or equipment as a result of unruly behaviour will be charged for.
  1. PERSONAL PROPERTY
  • Property belonging to the participant is at all times the responsibility of the participant unless any loss or damage is due to any negligence by Vision of Adventure or its representatives.
  1. COMPLAINTS
  • If the participant encounters any problem or difficulty Vision of Adventure will try and resolve them as soon as is possible. In the first instance report anything either to the instructor, the course director, or the office. If your complaint is not resolved to your satisfaction please write to the The Chair of Trustees, Steve Bateman, email address: steve@visREMOVEionofadventure.org.  Your concerns will be dealt with within 28 days of writing.
  1. FORCE MAJEURE
  • Vision of Adventure shall have no liability whatsoever in respect of any delay or failure in delivery of any of the courses or of any of Vision of Adventure’s other obligations due directly or indirectly to any cause whatsoever outside the reasonable control of Vision of Adventure including but not limited to Act of God, war, invasion, rebellion, riot, civil commotion, disorder, malicious damage, fire, flood, epidemic, quarantine restriction, strikes or other industrial disputes, unusually severe weather or energy supplies.
  1. LIABILITY
  • Vision of Adventure will not be liable where any failure in the performance of the Contract is due to: you; or a third party unconnected with the provision of the course and where the failure is unforeseeable or unavoidable; or any unusual and unforeseeable circumstances beyond Vision of Adventure’s control, the consequences of which could not have been avoided even if all due care had been exercised; or an event which Vision of Adventure or its suppliers, even with all due care, could not foresee or forestall. Vision of Adventure shall not be liable for any illness, injury or loss of life sustained on any course, except where such illness, injury or loss of life is caused by the negligence of Vision of Adventure or its employees, nor will Vision of Adventure be liable for any uninsured loss of personal property.
  • For all courses, you are advised to have insurance that covers you for all of the activities.
  1. PHOTOGRAPHS
  • From time to time photographs taken on Vision of Adventure’s courses may appear in Vision of Adventure’s promotional material. If participants do not wish to be photographed they should raise this with the course instructor at the time.
  1. DATA PROTECTION
  • The personal information requested by Vision of Adventure at the time of booking plus any subsequent information is held in on paper and digitally. The information is required to assist Vision of Adventure, employees, agents and sub-contractors to deliver the course and in maintaining Vision of Adventure’s high standards of delivery. By providing us with the information to process your booking you are agreeing that the information can be kept and accessed by authorised charity personnel. Contact details will be used to advise you of future offers by email ONLY if you have given us your permission to do so. If you have not given us your permission to keep you up to date with what is happening at Vision of Adventure we are unable to contact you for this purpose.
  1. APPLICABLE LAW
  • The contract will be governed by the laws of England any dispute will be dealt under the jurisdiction of the courts of England and Wales.
  • The statutory rights of the participant are not affected by the above.
  1. GENERAL
  • These booking conditions may only be waived or amended by a member of the Senior Management Team. Such waivers or amendments will only be made in special circumstances, and must be made in writing to be effective.
  • When making your booking it is implied and accepted that you have read and understood all these booking conditions and agree to abide by them.
  • Vision of Adventure shall ensure that appropriate security measures are in place to protect your personal data (as defined in the Data Protection Act 1998 and to comply with the General Data Protection Regulation). When you make a booking, you consent to all the information you provide being passed on to Vision of Adventure’s suppliers, agents, subcontractors, employees or volunteers whether based inside or outside the European Economic Area for the purposes of our providing you with the course.
